Do you think that your data available in your government is safe? Do you know of any legislation in your country regarding the data protection?

I don’t think that the availability of data in Government Organization is safe and secure nowadays.  Because, data available in Government Organization is entirely a public related data and it should always be disclosed under the public domain.  Anybody may know about the data available in Government Organization as per the requirement from time to time.  Being a citizen of India, I am quite sure that the Organizational data under Government control is in a safest position in Indian perspective.  As for example, when any grant is allocated for a particular project in India for the development of our society, lot of information regarding the same is published publicly by the department as well.  Hence, it is so easy to know about the information for that particular project in detail by the common masses.

After that, it can be spread out largely among citizens of the world.  On the other hand, we are living in a modern society where the social media also takes part to spread lot of news and information in a very rapid manner.  Under this system, the information regarding Government Organization is spread out among citizens and other non-interested people who actually don’t want smooth running of the society to keep pace with the whole world.  They are very shortly known as harmful element for the society and they generally misuse the resources by knowing these data from Government Organization.  At that time, Government faces lot of challenges to cope up the situation and use different mechanisms strategically by using its secret initiatives taken by the concerned departments.  During the pendency of any proceedings or investigation, nothing comes under public domain under the control of the Government (either Central or State).

As a result, the opponent cannot extract information what type of machinery are actually used by the Government against their threats.  Apart from this, we the people of republic India, have seen that lot of websites made by the Government organization are hacked by the terrorists or other harmful medias to provoke and destroy the good governances and infrastructure respectively.  Hence the Government data is not safe under any means for our common good in Indian Territory.


Yes, I know about my country’s law on data protection.  There is an amendment bill passed in our republic India in 2008 according to the Information Technology Amendment Bill, 2006.  It was passed in Lok Sabha / Lower House / House of Representatives on 22nd December, 2008 and in Rajya Sabha / Upper House / Council of Ministers on 23rd December, 2008.  This is entirely a legislative procedure under the administration of sovereign India.  This was passed to provide legal recognition for the transactions carried out by means of electronic data interchange and other means of electronic communication, commonly referred to as “Electronic Commerce” / “E-Commerce”.  It involves the use of alternatives to paper based methods of communication and storage of information to facilitate electronic filings of documents with the Government Agencies and further to amend the Indian Penal Code, 1860, Indian Evidence Act, 1872, The Bankers’ Books Evidence Act, 1891 and the Reserve Bank of India Act, 1934 and for matters connected therewith or incidental thereto.  The General Assembly of the United Nations has also adopted the Model Law on Electronic Commerce as per the resolution A/RES/51/162, dated 30th January, 1997 by the United Nations Commission on International Trade Law.

As per that resolution, our republic India has framed the law on Electronic Records and now we are getting facilitated by this Information Technology Act nowadays.  As for example in this context, we are submitting our varieties kind of forms / returns in Government Organization like Income Tax Department, Sales Tax Department, CST etc. within a fraction of seconds through web link by forwarding our digital signature which authenticates our submitted data in those Government Agencies.  All these are the legislative outlook and implementation at present in Indian Economy.  Excluding this, we are also utilizing the web links in all sectors of Education, Research, Training and working fields nowadays for our common benefit.  Hence it can remarkably be reiterated that we are really be successful in our own fields by using these Acts and Regulations framed by the Government of Sovereign, Socialist, Secular, Democratic and Republic India. – Tapas Kumar Debnath, India
